Open Document Licence

Preamble
This Open Document Licence ("The Licence") describes the Terms and Conditions under which the Open Document works published by the InterBase Developer Initiative ("IBDI") shall be distributed and redistributed.

Terms

The term "IBDI" refers to the organisation known as the "InterBase Developer Initiative".

The term "Original Work" is defined as "the version of the work originally published by the IBDI in any format", unless otherwise qualified.

The term "Larger Work" is defined as "The publication in which a work, subject to this Licence, is redistributed".

The term "Redistributed Work" is defined by the following description unless otherwise qualified:
"The Original Work, or parts thereof, modified or unmodified, in printed, printable, audible or other physically reproducible formats, including CD-ROM, magnetic disk or tape, compressed or non-compressed files intended for downloading from intranets or the internet or made available for public or restricted viewing on the Internet, whether distributed as a single publication or in serial or related parts; and all derivative redistributions of the Original Work."

The term "Commercial Product" is defined as "Any publication in printed or electronic format produced for sale or to promote the sale of another product". A distribution for which a nominal or reasonable charge is made to cover media and/or delivery costs shall not be considered a Commercial Product under these terms.

The term "Usage Fee" is defined as "Any charge or financial obligation, such as a Royalty or subscription charge, imposed on the usage of the Redistributed Work".

The term "Total Content of the Original Work" shall be quantified as the aggregate of the word count for textual content and the aggregate byte-count for graphical elements, as counted separately in the source materials of the original publication.

General Declaration of the Licence

IBDI hereby grants to the public a non-exclusive Licence to reproduce and distribute, in printed or electronic form, for commercial or non-commercial redistribution in a Larger Work, this Original Work hereby declared to be an Open Document, subject to the Terms and Conditions detailed herein.

IBDI reserves all rights not expressly granted herein.

Article 1: Limits to Proportion of Original Work Which May be Redistributed in a Commercial Product

1.0. Except for Redistributed Work that complies with the requirements defined in Article 4 with respect to Whole Document Translation, the Redistributed Work included in a Larger Work which is a Commercial Product under the terms of the Licence shall be permitted to contain a portion of the Original work, or parts thereof, modified or unmodified, not exceeding half of the total content of the Original Work, as defined under the terms of the Licence.

Article 2: Licence Citation

2.1.a. All Redistributed Work except that published for viewing on the Internet shall include a page or file citing all articles of this licence without modification in a form or format appropriate to the medium of publication.

2.1.b. All Redistributed Work published for public or restricted viewing on the Internet, shall include a hyperlink to a web page displaying this licence. For this purpose, this web page may be freely copied for display on another site.

2.2.a. Each portion of the Original Work thus redistributed shall carry an annotation containing, or conveying the precise sense of the following paragraphs:
Paragraph 1: "This work was originally published by the InterBase Developer Initiative ("IBDI") in a work entitled <Title of the Work> under the InterBase Developer Initiative Open Document Licence. You may redistribute this material, modified or unmodified, with the implicit permission of the author and the IBDI, free of Royalty, subject to the terms and conditions of that licence."

2.2.b. Where parts of the work are distributed in non-contiguous sections or files, the citation shall be repeated in each file or section.

Article 3: Requirements and Conditions With Respect to Authors' Rights

3.1. All Redistributed Work shall include an attribution to each individual author whose work is redistributed and a copyright notice in that author's name. Where an author's e-mail address is cited in the Original Work, it shall be cited also in the attribution.

3.2. Individual authors shall retain copyright to the Original Work and Redistributed Work in any form, including translations.

3.3. The assigning of exclusive rights to any party, with respect to the Original Work or the Redistributed Work, whether modifed or not, is forbidden.

3.4. No obligation exists to pay a Usage Fee for use of the Original Work in a Redistributed Work and no Usage Fee shall be charged for further redistribution of a Redistributed Work, whether modified or not. This clause shall not preclude the acceptance of a Royalty payment or Honorarium by the individual author of the Original work, provided no other condition of this Licence is violated.

3.5. If the Original Work is modified in the Redistributed Work, the person responsible for the modification shall be obliged to contact the author of the Original Work and inform him/her of the modifications, to arrange for the Original Work to be updated.

3.6.a. Inclusion of this Open Document Work, or any portion thereof, shall not cause this Licence to apply to other works included in the Larger Work.

3.6.b. Inclusion of this Open Document Work, or any portion thereof, in a Larger Work having a "copyleft" requirement is permitted but such inclusion shall in no way affect the licensing of the Original Work.

Article 4: Translations of This Open Document

4.1. This Open Document may be translated in its entirety for commercial publication provided the following conditions are met:

4.1.a. The translation shall be authorized by the Editor or Editors of this Open Document
4.1.b. The translator or translators shall claim no rights other than attribution for the work of translation
4.1.c. The translator or translators shall comply with all policies determined by the Editor or Editors of the Original Work, with respect to content, quality and version control and shall make a complete translation of the Original Work
4.1.d. The translator or translators shall not modify the content in any way which changes the intent of the author of the Original Work unless such modification is agreed to by the author and the Editor or Editors of the Original work

4.2. In the event that a complete translation of this Open Document is to be published commercially, the limits imposed on Commercial Products, as expressed in Article 1, shall be waived, provided the conditions of Articles 4.1 are met in full and that the publisher does not cause or permit violations of those Articles to occur.

4.3 Notwithstanding Articles 4.1 and 4.2, the redistribution of the Original Work or parts thereof in translation shall be considered a modified Redistributed Work to which the normal obligations apply.

The purpose of the special provisions for translations is to encourage the translation of the Work whilst ensuring that the content of the translated Work remains consistent with that of the Original Work.

"NO WARRANTY" PROVISION:  THIS OPEN DOCUMENT WORK IS LICENSED WITHOUT WARRANTIES OF ANY KIND, EXPLICIT OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF NON-INFRINGEMENT OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO THE MATERIAL IN THE OPEN DOCUMENT WORK AND TO SOFTWARE AND SOURCE CODE CONTAINED THEREIN AND TO TECHNIQUES DESCRIBED AND TO ASSERTIONS MADE IN THE OPEN DOCUMENT WORK.
